Terms of service
Last updated: 05/10/2026
This English version is provided for convenience. In case of any discrepancy, the Spanish version prevails.
These terms govern the relationship between [IMEXPO SA DE CV] (“internetymas.com”, “we”), tax ID [RFC POR DEFINIR], with address at [DOMICILIO FISCAL POR DEFINIR], México, and the individual or company ordering any of our services (“the Client”). By placing an order, paying an invoice or using a service, the Client accepts these terms, the Acceptable use & resources policy, the Service level agreement and the Privacy notice.
1. Definitions
- Shared hosting: space on a shared server with isolated resources, managed through cPanel.
- VPS: virtual server with reserved resources and root access.
- Backup server: external storage intended for backups.
- Domain: a name registered with the relevant registry (NIC México, Verisign or others) for a set period.
- Development: design of websites, web applications or iOS apps under a proposal accepted in writing.
- Client area: online system where the Client reviews services, invoices and tickets.
2. Ordering and activation
- The Client must provide true, complete and current information. We may request identity verification before activating a service.
- Shared hosting is usually activated within 1 to 24 business hours of payment confirmation; VPS and backup servers within 24 to 72 hours.
- Domain registration depends on availability when the payment is processed. We are not liable if a third party registers the domain first; in that case the amount is credited or refunded.
- Development projects start once the deposit stated in the proposal and the Client’s materials are received.
3. Prices, payment and invoicing
- Prices are in Mexican pesos plus VAT unless stated otherwise. Promotional prices apply only to the first term; renewals are billed at the current rate.
- Services are paid in advance for monthly, yearly or other stated terms. Authorised payment methods: SPEI transfer, card via payment link, OXXO and PayPal. No salesperson is authorised to collect payments by any other means.
- We issue a CFDI 4.0 electronic invoice for each payment using the registered tax details. The Client must keep them up to date; closed tax periods cannot be re-invoiced.
- We send renewal notices at least 15 days in advance. Prices may change due to third-party licence costs (cPanel, CloudLinux, domain registries) or exchange rates; we will give 30 days’ notice.
4. Non-payment, suspension and deletion
- If an invoice is unpaid when due, the service may be suspended from the 5th calendar day after.
- Suspended hosting accounts are kept for 15 calendar days; afterwards they may be deleted with their data and backups. VPS and backup servers are kept for 7 calendar days.
- Reactivating a suspended service requires full payment of outstanding balances.
- Unrenewed domains enter the registry’s grace period; later recovery may incur additional registry fees, passed on to the Client.
5. Satisfaction guarantee and refunds
- New shared hosting comes with a 30-calendar-day guarantee: if the Client cancels within that period, we refund the hosting fee.
- Non-refundable: domain registrations, renewals and transfers; VPS; backup servers; software licences; paid SSL certificates; migrations over 10 GB; and development work already delivered or approved.
- If the Client received a free domain with the plan and cancels within the guarantee, the domain registration cost is deducted from the refund and the domain remains the Client’s.
- Cancellations outside the guarantee period do not refund the paid term; the service stays active until it expires.
6. Cancellation and plan changes
- The Client may cancel at any time from the client area or by ticket. To avoid automatic renewal, request it at least 7 days before expiry.
- Upgrades apply immediately with the prorated difference charged. Downgrades apply at the next renewal.
7. Domains
- Domains are registered in the Client’s name, who is the owner. We act as intermediary with the registries and follow their policies (NIC México, ICANN and others).
- We provide the transfer (EPP) code on request, as long as the domain is active and has no outstanding balance.
- The Client must keep domain contact details current and respond to registry verification emails.
- Domain ownership disputes are resolved under NIC México’s LDRP or ICANN’s UDRP, as applicable.
8. What internetymas.com commits to
- Keep infrastructure availability in line with the SLA and issue credits when it is not met.
- Run automatic backups at each plan’s frequency and keep them for the stated number of days.
- Apply security updates to the operating system, panel and services on shared and managed servers.
- Protect the confidentiality of the Client’s data and content; we only access them for requested support, maintenance, security or a competent authority’s order.
- Give at least 72 hours’ notice of scheduled maintenance involving downtime, by email or in the client area.
- Answer tickets within the SLA response times, in Spanish or English.
- Deliver development work according to the scope, timeline and deliverables of the accepted proposal.
- Issue tax receipts for every payment and honour agreed prices during the contracted term.
9. Client responsibilities
- Use the services lawfully and in line with the Acceptable use policy.
- Keep passwords confidential, use strong passwords and enable two-step verification where available. Any action taken with the Client’s credentials is deemed taken by the Client.
- Keep installed software (WordPress, plugins, themes, frameworks) up to date and fix vulnerabilities in their own code.
- Keep their own copies of their data. Our backups are an additional measure and do not replace the Client’s copies.
- Own, or be licensed for, all content they publish, including text, images, software and trademarks.
- Comply with applicable data protection laws regarding their own customers’ and visitors’ information, including publishing their own privacy notice.
- Answer to third parties and to us for claims arising from their content or misuse of the services.
- Pay on time and keep tax and contact details current.
10. Technical support
- Included support covers infrastructure, panel, email, databases and DNS configuration.
- It does not include developing or debugging the Client’s code, configuring third-party plugins or themes, design, or system administration of unmanaged VPS. These can be quoted separately.
- Free migration applies to accounts up to 10 GB with working access to the source provider.
11. Development and design projects
- Scope, price, timeline and payment terms are set in the accepted proposal. Out-of-scope changes are quoted separately.
- Delays caused by missing information, materials or approvals from the Client shift the timeline accordingly.
- Upon full payment, the Client receives the economic rights to the code and design developed specifically for them. We keep the right to use generic components, our own and open-source libraries, and to show the project in our portfolio unless a confidentiality agreement says otherwise.
- App Store releases are made under the Client’s developer account and are subject to Apple’s approval, which is outside our control.
- We provide a 30-day warranty from final delivery to fix bugs attributable to our work.
12. Limitation of liability
- We are not liable for indirect damages, lost profits or data loss arising from: acts of the Client or third parties using their credentials; vulnerabilities in software installed by the Client; failures of power, telecom or domain registry providers; acts of God or force majeure.
- Our total liability to the Client for any claim is limited to the amount paid for the affected service in the previous 3 months.
- Downtime compensation is governed exclusively by the SLA.
13. Suspension for breach
We may suspend a service without notice when there is risk to the infrastructure or other clients, unlawful content, spam, malware, phishing or an authority’s order. We will tell the Client the reason and, where possible, allow them to fix it. Repeat offences may lead to cancellation without refund.
14. Changes to these terms
We may change these terms. We will publish the new version on this page and email 30 days’ notice when changes affect the Client’s rights or obligations. Continued use after that date implies acceptance.
15. Governing law and jurisdiction
These terms are governed by the laws of the United Mexican States. The parties submit to the competent courts of Merida, Yucatan, without prejudice to the Client’s consumer rights before PROFECO.
